Terms of Service

These Terms of Service ("Terms") govern your access to and use of the XyberRun mobile applications, website (including xyberrun.io), and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms.

1. The Service

XyberRun is a fitness tracking and social application. Features may include GPS tracking, performance analytics (including estimates such as VO₂ max, lactate threshold, or power where offered), social features, challenges, events, and achievements. Any fitness or health estimates are for informational purposes only and are not medical or laboratory-grade values. The Service does not provide medical advice.

2. Accounts and eligibility

  • You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service.
  • You agree to provide accurate, current, and complete information when you register, including date of birth where we ask

    Certain features may be offered as paid subscriptions or one-time purchases. Prices, billing intervals, and plans are shown in the app or on our website. Payments are processed by third parties (such as Apple, Google, or Stripe). Their terms, refund policies, and payment rules apply to those transactions.

    6. Content and intellectual property

    Your content: You retain ownership of content you submit (for example run posts, comments, profile information). By posting, you grant XyberRun a non-exclusive, worldwide license to host, display, and distribute that content as needed to operate the Service.

    Our rights: The Service, branding, software, and original materials are owned by XyberRun or our licensors and are protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or reverse engineer the Service except as allowed by law or with our express permission.

    We may remove content that violates these Terms or applicable law, or that we reasonably believe may harm the Service or other users.

    7. Privacy

    Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect personal information. Profile and location visibility (for example country, city, region, activity maps, and routes) may be controlled in the app's privacy settings and sharing flows, as described in the Privacy Policy.

    8. Third-party services

    The Service may integrate with third-party platforms (such as Google, Apple, X, Stripe), authentication providers (such as Clerk), database hosting (such as Neon for PostgreSQL), analytics, email, and other cloud services. Your use of those services is subject to their terms and privacy policies. We are not responsible for third-party services or content.

    9. Blockchain and digital asset features (optional)

    If we offer features involving blockchain, cryptocurrency, wallets, tokens, NFTs, or similar ("crypto features"), those features are financial in nature and may be restricted to users who are at least 18. We may use date of birth and/or additional verification to enforce age or jurisdiction rules. Crypto features may be provided by third parties; your use is subject to their terms and to applicable law. XyberRun does not provide investment, legal, or tax advice.

    10. Changes to the Service

    We may modify, suspend, or discontinue parts of the Service (with or without notice) where reasonable. We are not liable to you or third parties for any change, suspension, or discontinuance, except where prohibited by law.

    11. Termination

    You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, abuse the Service, or where required by law. Provisions that by their nature should survive (for example disclaimers, limitations of liability) survive termination. You may delete your account using in-app controls or by contacting us, where available.

    12. Disclaimers and limitation of liability

    THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, XYBERRUN AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

    Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the maximum permitted by law.

    13. Governing law

    These Terms are governed by the laws of the jurisdiction in which XyberRun operates, without regard to conflict-of-law rules, except where mandatory consumer protections in your country require otherwise.

    14. Changes to these Terms

    We may update these Terms from time to time. If we make material changes, we will provide notice in the app or by other reasonable means. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Service and may delete your account where available.
